Providing Social Security Disability (SSD) and Supplemental Security Income (SSI) Representation

Social Security Disability Insurance (SSDI)

SSDI Lawyer in Orange County, California

Under the government run Social Security Administration (SSA), "disability" is based on your inability to work. You will be considered "disabled" under SSA rules, if:

  • You cannot perform the work that you did before;
  • They decide that you cannot adjust to another job because of your medical condition; and
  • Your disability has lasted or is expected to last for at least one year or to result in death.

Attorney Benjamin H. Berkley and the Berkley Law Firm helps clients in Southern California obtain Social Security Disability Insurance. This is all that we do. Our clients are generally people who have worked hard for their living and now their bodies have worn down so they can no longer perform their job duties and earn a living wage.

Help at All Stages of Claims

Whether you are wondering how to file a claim, have had your initial claim denied, have been denied at the Request for Reconsideration or are wondering how to obtain an Administrative Appeal, The Berkley Law Firm can help you. We have a proven track record of satisfied clients and invite you to see what clients say about our work.

Obtaining Disability Benefits

You must have a physical impairment or a mental impairment (or combination of impairments) that has kept you from working for a year or is likely to prevent you from working. You can file a claim before you have been disabled for one year, but you must prove that your disability will last for at least one year.

How Is Disability Eligibility Determined?

The Social Security Administration relies on its own regulations to determine disability. A disability is very narrowly defined. Even if your doctor states you are disabled and cannot work, SSA may determine you do not have a disability.

Even if you have not worked, you may be eligible to apply for Supplemental Security Income, which is for those who have not paid into the Social Security system.
